The purpose of these conditions is to set out the terms and conditions under which AGALINO sells jewelery to its Customers (hereinafter referred to as “the Product(s)”) through the website www.agalino.com  (the “Site”).

The terms "We" or "Our" are used on www.agalino.com are used to communicate on behalf of AGALINO. This professionalizing choice thus makes it possible to communicate on behalf of AGALINO even if the products are handmade by Mrs. Alice GIROUX.

Our store is hosted on Wix.com. They provide us with the e-commerce platform that allows us to sell our products and services to you.

ARTICLE 1: OBJECT

These General Conditions of Sales exclusively govern sales made by AGALINO of the Products offered to buyers who are consumers (hereinafter the “Customer(s)) on the Site and specify the conditions of ordering, payment, delivery and management of any returns products ordered by Customers.

ARTICLE 2 - CUSTOMER

The Customer of the Site must be a consumer, an adult natural person and legally capable. The Customer must, during each order on the Site, complete an order form specifying certain mandatory fields so that his order of Products can be taken into account by AGALINO.

The information communicated to AGALINO within the framework of the opening of his customer account and during each of his orders must be complete, exact and up to date.

AGALINO reserves the right not to follow up on an order if it does not come from a customer who meets the criteria set out above.

ARTICLE 3 - PRODUCTS

Certain products or services may be exclusively available online on our website. These products or services may be available in limited quantities and may be returned in accordance with our Returns Policy.

We have done our best to display as clearly as possible the colors and images of our products that appear on our store. We cannot guarantee that your computer monitor display of colors will be accurate.
 
In the case of costume jewelery made by hand, certain lengths indicated may experience slight variations in size.
Similarly, some materials used may have irregularities inherent to their natural character or to this artisanal method of manufacture. The Customer thus acknowledges that the photographs, descriptions or graphics accompanying and illustrating the products offered for sale on the Site are indicative and non-contractual and cannot engage the responsibility of AGALINO in case of error, omission or modification.
 
Regarding personalization, the Customer acknowledges that he is content to "personalize"; a costume jewel created by AGALINO and that this "personalization" involves no creative effort. All intellectual property rights relating to the personalized product belong exclusively to AGALINO.

We reserve the right, but are not obligated to, to limit the sales of our products or services to any person, and in any geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any product or service we offer. All product descriptions and product prices are subject to change at any time without notice, at our sole discretion. We reserve the right to stop offering a product at any time. Any offer of service or product presented on this site is void where prohibited by law.

We do not warrant that the quality of any products, services, information, or other merchandise you have obtained or purchased will meet your expectations, or that any errors in the Service will be corrected.

ARTICLE 4 - ORDERS

In order to place an order, the Customer undertakes to communicate via the site only the real and valid information necessary for the performance of the service covered by these GCS. AGALINO cannot be held responsible for erroneous information transmitted by the Customer resulting in the non-performance of the service covered by these GCS. He will have the possibility, before definitively validating his costume jewelry order, to check the details of it its total price, and to correct any errors, before confirming it to express his acceptance.
 
AGALINO will be entitled to refuse any order made by a customer with whom there is a dispute relating to the payment of a previous order as well as any order that does not comply with these General Conditions of Sale.
 
The order form contains information on the essential characteristics of each of the products ordered: the price, the means of payment, the delivery methods. The contract is concluded when AGALINO  receives the order line form and the correctness of the order data has been verified. Before proceeding with the purchase of the products, the customer will be asked to carefully read the General Conditions of Sale.
 
The permanent or temporary unavailability of a product does not in any way engage the responsibility of the Seller and does not entitle the Customer to compensation or damages. After validation of the order by the Seller, the Customer receives a confirmation by e-mail.
 
In the event that the products presented on www.agalino.com are no longer available or for sale at the time of the last access to the site or the sending of the order form, AGALINO must inform the Customer promptly, and in any case, within thirty working days from the day following the order, of the possible unavailability of the products ordered.
 
In the event of a stock shortage of one of the materials used in the composition of a costume jewellery, AGALINO  may offer the Customer a replacement solution for the material, which does not affect its design. If the client refuses, AGALINO will take the necessary steps to refund the amount paid within 30 days of confirming the order.

After validation of your order, a notice of receipt will be sent by email to the Customer, containing a summary of the information of the order (essential characteristics of the product, price, means of payment, right of withdrawal, delivery times and costs).

ARTICLE 5 - PRICE AND TERMS OF PAYMENT

Price :
The Site offers payment via Credit Card or PayPal. When the order is finalized, AGALINO confirms the payment by sending the Customer a summary email.​
The prices displayed on the site are expressed in euros, all taxes included (VAT not applicable according to article 293 B of the General Tax Code). Packaging, order processing and shipping costs are indicated before validation of the order.​
AGALINO may modify the prices of the Products at any time and without notice, in particular due to changes in the economic, legislative and tax framework. The Products are invoiced on the basis of the price in force when the Customer places an order.
 
AGALINO cannot be bound by the display of an erroneous price, whatever the reason (computer bug, manual error, technical error, etc.) in this case,AGALINO will inform the Customer as soon as possible and the ordered item will be cancelled. Order processing and shipping costs are not included in the price. The processing and shipping costs are indicated before the validation of the order.

The telecommunications costs necessary to access the Seller's Internet Sites are the responsibility of the Customer.

Payment terms :
Payment is made online, either by credit card (Mastercard or Visa) with secure payment by our payment provider Stripe or via PayPal. Once the payment has been validated by the Customer, the transaction is immediately debited after verification of the information. In accordance with article L. 132-2 of the Monetary and Financial Code, the commitment to pay given by card is irrevocable. By communicating his banking information during the sale, the Customer authorizes the Seller to debit his card for the amount relating to the price indicated. The Customer confirms that he is the legal holder of the card to be debited and that he is legally entitled to use it. In the event of an error, or the impossibility of debiting the card, the Sale is immediately resolved as of right and the order cancelled. If necessary, a notification of order cancellation for non-payment is sent to the Customer by AGALINO on the e-mail address provided by the Customer when purchasing.


AGALINO reserves the right to suspend any order processing and any delivery in the event of non-payment. AGALINO retains full ownership of the products sold until full payment of the sums due by the customer in connection with his order, including costs and taxes.

ARTICLE 6 - DELIVERY

In accordance with the provisions of Article L 121-20-3 of the Consumer Code, the Products ordered are delivered within the deadlines indicated on the Site and during the confirmation of the order, and within 30 working days from of the order. The times indicated on the site and during the confirmation of the order are only indicative and correspond to the average time of processing and delivery of the package. 
Thus the average time for the receipt of packages is 5 to 8 working days from the completion of the order.
 
You will be notified of the shipment of your order by email, the tracking number of your package will allow you to follow its delivery.
Delivery is set to 3 euros in mainland France with no minimum purchase amount.

The Customer is solely responsible for a lack of delivery due to a lack of indication during the validation of the order.
The delivery method used is the Hungarian Tracked Letter (delivery in a post office box without signature with tracking number)
For any other delivery method (carrier, courier, etc.) please contact us directly. AGALINO who will make every effort to satisfy the Customer as far as possible and reasonable.
 
The package is delivered to the delivery address indicated when ordering by the customer. In the event that the package is damaged on delivery, the Customer must check the condition of the products or costume jewelery in his order and report to the carrier (the Post Office or other) any reservations in the event of a missing or damaged item. AGALINO can not be held responsible for the damage of a package during its delivery to the Customer. They are indicated to you on the site when validating the delivery method. AGALINO cannot be held responsible for any delay in delivery attributable to La Poste.
 
ARTICLE 7 - Returns

Anxious to give you complete satisfaction, we allow you to return your purchases to us, within 14 days of receipt of your order, whether it is a change of mind or a possible non-conformity. of one of our jewels. 

You can then choose, as you prefer, an exchange or a refund. 

Personalized jewelry cannot be refunded or exchanged.

The jewels must imperatively be returned within the time limit, in perfect condition, unworn, and in their original packaging(s).

Otherwise, no exchange or refund can be accepted. 

In the case of non-compliance of one of our jewels, the return costs will be borne by  AGALINO.

In all other cases, return costs will be at your expense. 

We recommend a type of tracking and appropriate shipment, we cannot be responsible in the event of non-receipt of your return package.

Whatever the reason, Contact our customer service  so that we can arrange your return.

ARTICLE 8 - Refunds 

Once we have received and inspected the returned item, you will be contacted by email to confirm receipt of your return. We will also notify you of our decision on whether to approve or reject your refund request. 

If your request is approved, your refund will then be processed, and a credit will automatically be applied to your credit card or original method of payment, within 10 (working) days.
All items available for sale can be refunded by us under certain conditions. 

Late refunds 

If you haven't received your refund yet, please check your bank account again first.

No one is authorized to reproduce, exploit or use for any reason or in any way whatsoever, in whole or in part, the elements of the Site, whether software, visual or sound.

The Customer is prohibited from any act of reproduction or use of product models, trademarks, distinctive signs, inventions, techniques or know-how used by AGALINO as well as any act tending to the appropriation of these elements, whether or not they are the subject of protection by AGALINO by a patent, trademark, registered design and model or a copyright.

ARTICLE 10 - PROTECTION OF PERSONAL DATA

The personal information relating to the Customer is essential for the processing, the routing of the orders as well as the establishment of the invoices.
AGALINO undertakes not to disclose to third parties the information communicated by the Customers on the site. These are confidential. They will only be used for the processing of his order and the follow-up of commercial relations and will be treated in complete confidentiality taking into account the personal data communicated by the Customer.
 
ARTICLE 11 - INDEPENDENCE

Each party is and remains entirely independent, master of the management of its affairs and responsible for all of its actions and assumes all of the risks associated with its activities.

ARTICLE 12 - RESPONSIBILITIES

The responsibility of AGALINO cannot be engaged in the event of non-performance or poor performance of the contract, due either to the Customer's act, or to the unforeseeable and insurmountable fact of a third party to the contract, or to a case of force major. The Customer is responsible for the proper use of the Products purchased.AGALINOcan in no way assume responsibility in the event of an accident on the Customer or on a third party (ingestion, strangulation, suffocation, etc.). AGALINO recommends keeping the Products out of the reach of the most vulnerable children.
 
AGALINO cannot be held responsible for any deterioration of the products offered.

ARTICLE 13 - APPLICABLE LAW AND DISPUTE

The language of this contract is French.
These general conditions of service are subject to French law.
In the event of absence of amicable resolution of the dispute, the courts of Aix-en-Provence are competent.
In the event that a dispute arises between the parties as a result of the execution or interpretation of these general conditions of sale, the parties agree prior to any legal action that any claim will be the subject of a formal notice. beforehand by registered mail with request for acknowledgment of receipt.
